1. Introduction
Welcome to AZIVON. These Terms and Conditions establish the general rules applicable to access to and use of the website, platform, Client Area and services made available by AZIVON.
By creating an account, accessing certain features or using the services made available by AZIVON, the user declares that they have read, understood and accepted these Terms and Conditions.
2. About AZIVON
AZIVON provides a technological and operational structure that allows users to access professional management of trades in the financial markets through a PAMM structure maintained with the partner broker.
AZIVON does not act as custodian of investors’ funds. Funds allocated to trading are deposited and remain held directly with the broker, subject to the terms, conditions, procedures and rules applicable to the investor account and the PAMM structure.
3. Broker and PAMM account
To participate in AZIVON’s PAMM structure, the user must have an eligible account with the partner broker currently used by AZIVON, BlackBull Markets, and comply with the registration, identification, KYC and other requirements established by the broker.
Account opening, registration approval, deposits, withdrawals, custody of funds and other brokerage services are carried out directly by the broker and are subject to its own terms and conditions. BlackBull Markets is a company independent of AZIVON.
4. Minimum capital
The minimum capital established for participation in AZIVON’s PAMM account is US$ 100. Availability of participation may be subject to operating requirements and conditions established by the broker and the PAMM structure.
5. Trading and management
AZIVON’s trades are executed manually by experienced traders, including professionals with more than 10 years of experience in the financial markets. AZIVON does not use robots, Expert Advisors (EAs), Artificial Intelligence or other automated systems to autonomously make buy and sell decisions. Technology tools may be used for analysis, monitoring, infrastructure, control and tracking of trades.
6. Risks
Trading financial instruments involves risks and may result in the partial or total loss of the capital allocated to trading. Previous results, historical performance, statistics or any other information related to past performance do not represent a guarantee of future results.
The use of risk management, hedging, professional analysis or experienced traders does not eliminate the risks inherent to the financial markets. By participating in the PAMM structure, the investor declares that they understand and accept these risks.
7. Performance Fee
AZIVON charges a 30% performance fee on eligible profits, calculated and charged weekly.
The fee uses the High-Water Mark (HWM) system so that the performance fee is not charged again merely on the recovery of previous losses.
8. Administrative Fee
AZIVON may charge a weekly administrative fee, calculated on the investor’s current total capital in the PAMM account. The applicable percentage will be determined according to the investor’s capital tier at the time of the charge:
Weekly administrative fee by investor’s total capital
· US$ 500 to US$ 24,999.99: 0.10%
· US$ 25,000 to US$ 99,999.99: 0.07%
· US$ 100,000 to US$ 499,999.99: 0.05%
· US$ 500,000 to US$ 999,999.99: 0.02%
· US$ 1,000,000 or more: 0.00% (exempt)
The calculation base considers the investor’s current total capital at the time of assessment and not only the amount originally invested.
9. Rewards Program
AZIVON may make available to its users a referral-based Rewards Program. Of the 30% performance fee charged by AZIVON, 10% is allocated to the Rewards Program, which may be distributed across up to five levels:
· 1st level: 5%
· 2nd level: 2%
· 3rd level: 1%
· 4th level: 1%
· 5th level: 1%
Rewards are related to eligible performance fees generated by accounts linked to the referral network and are not calculated on deposits or on capital invested by participants. A participant’s mere registration, referral or deposit does not automatically generate a reward.
10. Identification of referrals
Each eligible user may receive a unique AZIVON referral link. When a person registers through that link, the referral relationship may be recorded by the platform. To participate in the PAMM, the referred user must complete the necessary procedures with the broker and subsequently link their MT5 investor account to their AZIVON account.
This linking allows the system to identify the participating account and carry out calculations related to the Rewards Program according to the recorded referral structure.
11. Crediting and withdrawal of rewards
Eligible rewards will be calculated according to the applicable cycles and made available in the rewards balance of the AZIVON Client Area.
When a balance is available for withdrawal, the user may request payment in USDC to a registered cryptocurrency wallet, subject to applicable security procedures, verification, limits and other conditions.
The user is responsible for correctly providing the wallet address and selecting a compatible network where applicable. Transactions carried out on blockchain may be irreversible.
12. Deposits and withdrawals of capital
Deposits intended for participation in the PAMM are made through the broker’s infrastructure. Likewise, requests to withdraw invested capital will be subject to the conditions of the broker and the PAMM structure.
The availability of certain amounts for withdrawal may depend, among other factors, on open positions, margin in use, security procedures and applicable operating conditions.
13. Performance information
AZIVON may provide on its website or platform information related to trading performance, including daily, monthly and accumulated results, drawdown and other indicators.
This information is historical and informational in nature. Past results do not guarantee future results.
14. User responsibilities
The user is responsible for providing true, complete and up-to-date information during registration and for the security of their access credentials.
The user must also ensure that their participation in the services made available by AZIVON is permitted by the laws and regulations applicable in their country or jurisdiction of residence.
15. Availability of services
AZIVON’s services may not be available in certain countries or jurisdictions. AZIVON may establish access or eligibility restrictions when necessary to comply with legal, regulatory or operational requirements or requirements related to its partners.
16. Changes to the services and these Terms
AZIVON may update these Terms and Conditions when necessary to reflect changes to its services, operating structure, partners, legal requirements or internal policies. Where applicable, material changes may be communicated to users through the website, platform, Client Area or other official channels.
17. Intellectual property
The AZIVON name, its visual identity, website, platform, content, texts, materials, systems and other brand-related elements are protected by applicable intellectual-property laws. None of these elements may be reproduced, distributed or used commercially without authorization, except where permitted by law.
18. Privacy and data protection
The processing of personal data carried out by AZIVON will be governed by the Privacy Policy and other applicable policies made available on the platform. By using the services, the user acknowledges that certain data may be required for registration, security, support, platform operation and compliance with legal and regulatory obligations.
19. Prevention of money laundering and fraud
AZIVON may adopt procedures intended to prevent money laundering, financing of unlawful activities, fraud and misuse of its platform. When necessary, additional information or documents may be requested from users.
20. Limitation and nature of information
The information made available on AZIVON’s website and platform does not constitute a promise or guarantee of profitability. No information regarding historical results, markets, trades or performance should be interpreted as a guarantee of future results.
Each investor should assess their own financial situation, objectives and risk tolerance before participating.
